Payment Information

Introduction

The following conditions apply to the sale of materials or equipment, and to the hire, servicing of repair of goods supplied, repairs or serviced by Shire Oak Ltd. Hereafter called 'the company'. No alterations or additions to nor exclusion of any part of these conditions shall be valid in law unless specifically agreed in writing by a director of the company.

Our acceptance of your order by delivery of the goods constitutes a legally binding contract between the buyer and the company on these terms and conditions.

Meanings

"Buyer" herein shall include the buyer, hirer, lessee, owner or any other person who is in charge of goods supplied by the company. 'Goods', shall include materials, equipment, spare parts and any other item supplied, serviced, repaired, loaned or hired by the Company.

Prices and Terms of Payment

Charges for goods and services supplied by the Company shall be paid in full on or before delivery or completion. The price payable for goods ordered is set out on our website. Upon agreement of contract between the buyer and the company these prices are non negotiable.

Legal Ownership

The property in and title to goods supplied by the company shall remain within the company until:

• a) The buyer shall have paid the price plus VAT in full and
• b) No other sums whatever shall be due from the buyer to the seller

Specification of goods:

Defects

It is the responsibility of the buyer to examine goods supplied by the company and to identify defects in materials and/or workmanship which might cause damage or injury. No claims for damages or discrepancies can be made after installation as installation of our materials constitutes acceptance of the product in its current state.

While the company endeavours to hold sufficient stock to meet all orders, if insufficient stock is held or the stock item has been discontinued, the company may offer a substituted product and provide a sample for confirmation of acceptance.

Installations

Where assembly of the goods supplied by the company is not undertaken by the company the buyer shall be responsible for assembly in accordance with the company's instructions and shall ensure that such instructions have been obtained from the company. Failure to assemble goods in the manner prescribed in the instructions supplied with goods will invalidate the Company's responsibility for damage caused to or by the goods.

Advice, Information and Opinion

Before you place an order it is important that you check the manufacturer's specification details for suitability of their intended purpose. If you are unsure about the suitability of the goods then please ask us.

Shire Oak Ltd cannot guarantee the colour/pattern matching from a computer monitor. Therefore, it is recommended you view the product.

Limit of Liability

The company shall not be liable for damage or injury caused by its goods or workmanship beyond replacement of goods or work verification of the buyer's complaint. The company shall not be liable for any consequential loss caused by its failure or delay in supplying, servicing or repairing goods, whether the loss arises from the actions or from the omissions of the company, its employees, agents or subcontractors.

Deliveries

We will advise you at the time of order whenever possible of approximate delivery lead-times. If there is a likelihood of a delay or we cannot fulfil your requested delivery date we will call you to discuss alternative options. All times and dates for dispatches and deliveries quoted are estimates and not binding on the company.

Times given are on a best endeavours basis and are subject to force majeure. Claims by the buyer for shortages or non-delivery must be made to the company within seven days of the delivery date.

Check all goods on delivery before you sign for them.

Our delivery service is made to the 'kerb side' not inside the house, due to insurance guidelines so please arrange for adequate help to off load. Your delivery could be made on a lorry or a van so it is assumed that the delivery address will be accessible. If there is likely to be a problem, e.g. the road is subject to a vehicle weight or width restriction, it is within a "Red route" or there are time zone restrictions for example, please inform us at the time of order to discuss alternative delivery options.

Deliveries are made when the order is complete from approximately 8.00 am to around 6.00 pm. Unfortunately requests for an E.T.A (Estimated Time of Delivery) are at the courier's discretion. If your order arrives as arranged but we are unable to deliver because you are not home, or there is inadequate help available, you will be liable for any additional costs incurred for redelivery.

Shire Oak Ltd has teamed up with reliable delivery partners to ensure delivery service levels are maintained. Therefore it is important to check the packaging for any visual damage to the goods and sign for your order on arrival. If you are unfortunate to receive damaged goods, or there are missing, item(s) please make sure it is noted on the courier's paperwork. We also strongly suggest that you contact us direct as soon as possible to make sure we are aware of the problem. This notification should be made to the company within seven days of receipt of the goods.

We cannot be responsible for any consequential losses. Therefore we advise against booking installers until goods have been received and checked. Where goods are refused on delivery that are found to be undamaged on return we reserve the right to pass on any carriage charges that we incur in returning the goods to us and resending to you.

• Please check goods on delivery.
• If the driver won't wait while you check the items, either don't sign for them and send them back and ring us with the name of the driver or accept the goods but we are not liable if they are damaged.
• If the packaging is intact, please do not assume that the goods are undamaged.

Returns Policy

You have the right to cancel the order at any time up to 7 days after the delivery date. We will refund the price paid for the goods less the cost price of transportation back to our warehouse. Goods must be returned to us in good saleable condition, and in their original wrappers.

Cancellations must be made in writing; this includes letter or email.

Guarantees

Any guarantees given will be invalidated if the goods supplied by the company are subject to misuse or accidental damage after the buyer had taken delivery of them.

It is advisable that you do not book a flooring fitter until you have had the delivery of the goods to ensure your wood is left to acclimatise. Damage caused to and by goods which are fitted without consideration for acclimatisation cannot be compensated for by the company.

Product Representation

Owing to the nature of digital photography and other such media, the products shown on this website and in any accompanying media may differ slightly in proportion and colour due to limitations of browser software and monitors. Our products are derived from natural sources and so are subject to natural variations in colour, shade and general appearance. In some cases there maybe sap wood.

Termination

The company reserves the right to suspend further supply or delivery, stop any goods in transit or terminate contract by notice in writing to the buyer should the buyer breach an obligation hereunder or become unable to pay any owed amount as it becomes due. Upon termination, your indebtedness to the company becomes immediately due and payable and the company shall be under no further obligation to supply goods to the buyer.

Goods which have been ordered in will be held for 1 week unpaid before being returned to stock to sell on

Your privacy is of the highest importance to us, and we promise never to release your personal details to any outside company for mailing or marketing purposes.

We realise how important it is to securely store any information that you provide.

All information gathered including any information given at the time of ordering is collected lawfully and in accordance with the Data Protection Act 1998.

In no event will we be liable for any loss or damage including without limitation, or any loss or damage whatsoever arising from loss of data or profits arise out of, or in connection with, the use of this website.

Through this website you are able to link to other websites which are not under the control of Shire Oak Ltd. We have no control over the nature, content and availability of those sites. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.

Every effort is made to keep the website up and running smoothly. However, Shire Oak Ltd takes no responsibility for, and will not be liable for, the website being temporarily unavailable due to technical issues beyond our control.

Trade Terms & Conditions

In the event of non-payment of sums due to the company from the buyer, the company shall be entitled to enter the buyer's Premises and to physically re-possess and remove there from similar goods supplied by the company for which payment has not been received. It will be assumed that where the buyer purchases similar goods from the company on a regular basis that a stock rotation system had operated and goods still held relate to invoices still outstanding for which full payment plus VAT hasn't been made.

Trade goods returned undamaged / incorrect will incur a 25% restocking fee and delivery costs are non refundable. Further delivery costs may be incurred if the undamaged / incorrect items need to be collected by ourselves.
